TABIJI Japanese 申込規約 / TABIJI Japanese Terms of Service

本規約は、TABIJI Japanese（以下「当社」といいます。）が提供する日本語オンラインコーチング、対面レッスン、各種コンサルティングサービスその他これらに付随するサービス（以下「本サービス」といいます。）の利用条件を定めるものです。
These Terms of Service (hereinafter referred to as the "Terms") define the conditions for using the Japanese online coaching, in-person lessons, various consulting services, and other related services (hereinafter referred to as the "Services") provided by TABIJI Japanese (“TABIJI,” “we,” “us,” or “our”). 

第1条（適用・契約の成立） / Article 1 (Scope of Application and Formation of Contract)
1.    本規約は、本サービスを申し込む者（以下「受講者」といいます。）と当社との間の本サービスに関する契約（以下「利用契約」といいます。）に適用されます。
These Terms apply to the contract regarding the Services (hereinafter referred to as the "Service Contract") entered into between the person applying for the Services (hereinafter referred to as the "Student") and TABIJI. 
2.    本サービスの内容、受講料、提供期間、レッスン回数その他の個別条件は、申込画面、見積書、申込書、当社からの案内その他当社が提示する個別の条件（以下「個別条件」といいます。）に定めます。個別条件と本規約が抵触する場合、個別条件に別段の定めがある範囲で個別条件を優先します。
The details of the Services, tuition fees, provision period, number of lessons, and other specific terms shall be determined in the application screen, quotation, application form, notices from us, or other individual conditions presented by us (hereinafter referred to as "Individual Terms"). In the event of any conflict between the Individual Terms and these Terms, the Individual Terms shall prevail to the extent of such conflict. 
3.    利用契約は、当社が申込みを承諾し、受講料の決済その他個別条件に定める契約成立条件が満たされた時点で成立します。
The Service Contract shall be formed when we accept the application and the conditions for contract formation specified in the Individual Terms, such as payment of tuition fees, are satisfied. 
4.    本規約への同意は、個人情報の取扱いに関する同意その他法令上別途同意が必要となる事項についての同意を当然に意味するものではありません。
Agreement to these Terms does not automatically constitute consent to matters that require separate consent under applicable laws and regulations, such as the handling of personal information. 

第2条（受講料・支払方法等） / Article 2 (Tuition Fees, Payment Methods, etc.)
1.    受講料は、個別条件に表示する金額とします。
Tuition fees shall be the amount indicated in the Individual Terms. 
2.    支払方法、支払期限その他の支払条件は、個別条件に定めます。
Payment methods, payment deadlines, and other payment terms shall be defined in the Individual Terms. 
3.    海外送金手数料、受講者の利用する決済手段に係る手数料その他受講者側で発生する費用については、個別条件に別段の定めがない限り、受講者の負担とします。
Unless otherwise specified in the Individual Terms, overseas remittance fees, transaction fees associated with the Student's chosen payment method, and any other costs incurred on the Student's end shall be borne by the Student. 
4.    受講者の居住地その他の事情により税金、関税その他の公租公課が発生する場合、その負担については法令および個別条件に従うものとします。
If taxes, customs duties, or other public charges arise due to the Student's place of residence or other circumstances, the burden thereof shall be determined in accordance with applicable laws and regulations and the Individual Terms. 

第3条（受講期間・予約・変更・キャンセル） / Article 3 (Course Period, Bookings, Rescheduling, and Cancellations)
1.    受講期間および未受講分の取扱いは、個別条件に定めます。受講者の都合により受講期間内に利用しなかったサービスについて、当社に帰責事由がない場合は、原則として期間の延長または返金を行いません。
The course period and the handling of unused sessions shall be defined in the Individual Terms. In principle, no extensions of the period or refunds will be granted for Services not utilized within the course period due to the Student's convenience, unless TABIJI is at fault. 
2.    レッスンの日時変更またはキャンセルは、レッスン開始予定時刻の24時間前までに、当社が指定する方法で手続きしてください。
Rescheduling or cancellation of a lesson must be completed at least 24 hours prior to the scheduled lesson start time using the method designated by TABIJI. 
3.    前項の期限を過ぎたキャンセルまたは無断欠席については、当該レッスン1回分を実施したものとして取り扱うことがあります。ただし、法令上許される範囲を超えてキャンセル料その他の負担を課すものではありません。 Cancellations made after the deadline specified in the preceding paragraph or absences without notice may be treated as a completed lesson. However, this shall not impose cancellation fees or other burdens beyond what is permitted by law. 
4.    契約成立後の受講者都合による解約・返金については、個別条件に別段の定めがない限り、法令上認められる解除・取消し等の場合を除き、原則として受け付けません。
Cancellations or refunds requested by the Student after the formation of the contract will not be accepted in principle, unless otherwise specified in the Individual Terms or recognized under applicable laws (such as statutory cancellation rights). 
5.    当社の都合により本サービスの提供が不能となった場合は、未提供分について、法令および個別条件に従い、振替、代替提供または返金等の対応を行います。
If the provision of the Services becomes impossible due to our circumstances, we will respond regarding the unprovided portion by offering rescheduled sessions, alternative services, or refunds in accordance with applicable laws and the Individual Terms.
 
第4条（対面レッスン・実費） / Article 4 (In-Person Lessons and Actual Expenses)
1.    対面レッスンは、実施日時、場所、内容および費用等について当社と受講者が個別に合意した場合に実施します。
In-person lessons shall be conducted when TABIJI and the Student mutually agree on the date, time, location, content, costs, and other details individually. 
2.    対面レッスンに伴う講師の交通費、宿泊費、出張費、会場費その他の実費について受講者が負担する場合、その内容および金額または算定方法を、原則として事前に提示します。
If the Student is to bear actual expenses associated with in-person lessons, such as the instructor's transportation, accommodation, travel, or venue fees, the details, amounts, or calculation methods shall, in principle, be presented in advance. 
3.    カフェ、レストラン等で実施する場合の受講者自身の飲食費等は受講者の負担とし、講師の飲食費等を受講者に負担いただく場合は、事前にその旨を明示し、同意を得るものとします。
If lessons are conducted in cafes, restaurants, etc., the Student's own food and beverage expenses shall be borne by the Student. If the Student is requested to cover the instructor's food and beverage expenses, prior explicit notice and consent shall be obtained. 

第5条（受講環境・時刻） / Article 5 (Learning Environment and Standard Time)
1.    オンライン受講に必要な通信機器、通信回線、ソフトウェアその他の環境は、受講者の責任と費用で準備するものとします。 Telecommunication equipment, internet connections, software, and other environment required for online lessons shall be prepared at the Student's own responsibility and expense. 
2.    レッスンの日時は、原則として日本標準時（JST、UTC+9）を基準とします。受講者の時差の認識違い、通信環境の不備その他受講者側の事情により受講できなかった場合、当社に帰責事由がない限り、振替または返金を行わないことがあります。
Lesson dates and times shall in principle be based on Japan Standard Time (JST, UTC+9). If a Student is unable to attend due to time zone misunderstandings, connection issues, or other circumstances on the Student's end, rescheduled sessions or refunds may not be provided unless TABIJI is at fault. 
3.    当社の責めに帰すことのできない通信障害、システム障害その他の事情により一時的に本サービスを提供できない場合、当社は可能な範囲で振替その他の代替措置を講じます。
If the Services cannot be provided temporarily due to telecommunication failures, system failures, or other circumstances not attributable to TABIJI, we will take alternative measures, such as rescheduling sessions, to the extent feasible. 

第6条（知的財産権・利用制限） / Article 6 (Intellectual Property Rights and Usage Restrictions)
1.    本サービスに関連して当社が提供する教材、動画、音声、講義資料、文章、画像その他のコンテンツに関する著作権その他の知的財産権は、当社または正当な権利者に帰属します。
Copyrights and other intellectual property rights regarding teaching materials, videos, audio, lecture documents, texts, images, and other contents provided by TABIJI in connection with the Services belong to TABIJI or legitimate right holders. 
2.    受講者は、自己の学習目的または利用契約の目的の範囲を超えて、当社の事前の承諾なく、前項のコンテンツを複製、転載、公開、販売、配布、第三者に提供し、または録音・録画等により利用してはなりません。
Students shall not copy, reprint, publish, sell, distribute, provide to third parties, or record/audio-record the contents specified in the preceding paragraph beyond the scope of their personal learning or the purpose of the Service Contract without our prior written consent. 
3.    前二項は、法令により認められる利用を妨げるものではありません。
The preceding two paragraphs shall not prevent uses permitted under applicable laws and regulations.
 
第7条（秘密保持・禁止事項） / Article 7 (Confidentiality and Prohibited Actions)
1.    受講者は、本サービスを通じて知り得た当社、講師、他の受講者その他第三者の非公開情報を、正当な権限なく第三者に開示または漏えいしてはなりません。
Students shall not disclose or leak non-public information of TABIJI, instructors, other students, or third parties obtained through the Services to any third party without legitimate authority. 
2.    受講者は、他の受講者への無断の営業・勧誘、講師その他当社関係者への不当な引抜き・勧誘、他者への迷惑行為、差別的・脅迫的・ハラスメントに当たる行為その他本サービスの運営を妨げる行為をしてはなりません。 Students shall not engage in unauthorized sales or solicitations toward other students, improper poaching or solicitations toward instructors or TABIJI-related parties, acts causing nuisance to others, discriminatory, threatening, or harassing behavior, or any other acts that interfere with the operation of the Services. 
3.    前項に違反し、またはその他本サービスの継続が困難となる相当の理由がある場合、当社は、事前の催告なく、受講停止、利用契約の解除その他必要な措置を講じることがあります。この場合の返金等については、法令および当社の責任の有無・程度を踏まえて取り扱います。
In the event of a violation of the preceding paragraph or if there are reasonable grounds that make continuation of the Services difficult, TABIJI may suspend the Student's attendance, terminate the Service Contract, or take other necessary measures without prior notice. Refunds in such cases will be handled based on applicable laws and the degree of TABIJI’s responsibility, if any. 

第8条（サービスの性質・免責） / Article 8 (Nature of Services and Disclaimer)
1.    本サービスは、日本語の知識、技能、運用方法その他の情報および指導を提供することを目的とするものであり、JLPTの合格、昇進、転職、売上増加、商談成立その他特定の成果を保証するものではありません。
The purpose of the Services is to provide knowledge, skills, practical methods, and guidance regarding the Japanese language, and does not guarantee any particular result or outcome, such as passing the JLPT, promotion, career changes, revenue growth, or successful business negotiations. 
2.    当社は、法令上免責が認められない場合を除き、受講者の事業判断その他受講者自身の行為について責任を負いません。
Unless disclaimer is prohibited by law, TABIJI shall not be held liable for business decisions or other actions made by the Student. 
3.    当社の責めに帰すべき事由により受講者に損害が生じた場合の当社の責任は、法令に従うものとします。受講者が消費者に該当する場合、消費者契約法その他の強行法規に反する免責または責任制限は行いません。
If damage is caused to the Student due to reasons attributable to TABIJI, our liability shall be determined in accordance with applicable laws. If the Student qualifies as a consumer, disclaimers or limitations of liability that violate the Consumer Contract Act or other mandatory laws shall not apply. 

第9条（規約の変更） / Article 9 (Amendments to Terms)
当社は、法令に従い、変更の必要性、変更内容の相当性その他の事情を考慮した上で、合理的な範囲で本規約を変更することがあります。変更する場合は、変更内容および効力発生日を、当社ウェブサイトへの掲載その他適切な方法により周知します。
We may amend these Terms within a reasonable scope in accordance with applicable laws, taking into consideration the necessity of modification, appropriateness of modified content, and other relevant circumstances. In such cases, the modified content and effective date will be published on our website or communicated through other appropriate methods. 

第10条（準拠法・管轄・正文） / Article 10 (Governing Law, Jurisdiction, and Controlling Language)
1.    本規約および利用契約は、日本法に準拠して解釈されます。
These Terms and the Service Contract shall be governed by and construed in accordance with the laws of Japan. 
2.    本サービスに関して当社と受講者との間で紛争が生じた場合、法令上専属的合意管轄を定めることが許される場合に限り、神戸地方裁判所または神戸簡易裁判所を第一審の専属的合意管轄裁判所とします。
In the event of any dispute arising between TABIJI and the Student regarding the Services, the Kobe District Court or Kobe Summary Court shall be the exclusive agreed court of first instance, provided that agreeing on exclusive jurisdiction is permitted under law. 
3.    本規約の日本語版を正文とします。翻訳版を作成した場合、日本語版と翻訳版との間に齟齬があるときは、日本語版を優先します。
These Terms of Service are provided in both Japanese and English. In the event of any discrepancy or inconsistency between the Japanese and English versions, the Japanese version shall prevail.
